GREEN BAY - The City of Marinette is denying claims that its sign ordinance is unconstitutional.
Kristin Abbs filed suit in federal court, alleging the city's ordinance - requiring permits and a $15 fee to the city for the right to display the signs - is illegal as it pertains to political signs.
In court documents filed this week, the city's attorney denied the allegations. The city also claims Abbs may not have the standing required to file the suit, and says it wasn't properly served the suit.
A motions hearing is scheduled for Thursday afternoon before Federal Judge William Griesbach. The plantiffs asked for a temporary restraining order prohibiting the city from enforcing the ordinance. Griesbach did not rule on the request earlier this month but the parties are expected to appear in court tomorrow.
