Trial ordered in double murder

Schmidt allegedly killed a woman and her brother

OCONTO - Daniel Schmidt will stand trial for the murder of a brother and sister, a judge ruled Wednesday.

Schmidt, 29, allegedly shot and killed 32-year-old Kimberly Rose and 21-year-old Leonard Marsh at their home in Gillett in 2009.

According to the criminal complaint, Schmidt's relationship with Rose may have led to the shootings.

The report states Schmidt had an affair with Rose. Investigators say Schmidt eventually told his wife about the affair. However, days before the crime, the report says the couple decided to try to work through their problems.

According to the complaint, "Stephanie (Schmidt) reported to law enforcement that during counseling, Schmidt seemed agitated by the affair and stated that he just wanted to be done with her (Rose)."    

The report also states Daniel Schmidt owned a .20 guage shotgun, which officials believe was the weapon used in the murders. Police say Schmidt admitted he possessed a .20 guage during his lifetime, but denied he had the gun during the time of the homicides.

When it came to an alibi, investigators say Schmidt gave inconsistent stories about his whereabouts the morning of the murders.

Arraignment is scheduled for Oct. 26.
