Appeals court: Witness to killing should testify

MADISON, Wis. (AP) - A state appeals court says a judge was wrong to block testimony from a woman who claims she witnessed the killing of a Milwaukee man.

The First District Court of Appeals ruled Tuesday that the woman, Arnetta Childress, should be allowed to testify at Alexander Wiley's trial beginning in February. Wiley is charged with first-degree reckless homicide in the 2011 death of Darrin Moore.

Childress says she was near the scene of the killing and identified Wiley as one of two men who fired shots at Moore.

But Milwaukee County Circuit Judge Richard Sankovitz wouldn't allow her testimony, saying it wasn't clear she was familiar enough with Wiley to identify him in court.

But the appeals court overturned that, saying Childress could identify Wiley because she's known him for years.
