MILWAUKEE (AP) - The defense attorney for a former aide to Gov. Scott Walker wants charges against the aide thrown out, saying the prosecution is based on "immunized testimony."
Kelly M. Rindfleisch served on Walker's staff when Walker was the Milwaukee County executive. She's charged with four felony counts of misconduct in office, stemming from allegations that she did campaign work on county time.
Defense attorney Frank Gimbel filed motions this week asking that the charges be dismissed. He says the allegations are based on information Rindfleisch gave under a non-prosecution agreement in a separate 2002 case. He wants the current case tossed and the prosecution barred from bringing new charges.
The prosecution has filed its own motions seeking permission to introduce more email evidence.
Rindfleisch has a pre-trial hearing on July 19.
