A Kewaunee County farm's effort to have a challenge to its waste permit dismissed has been denied by the state.
The DNR granted a permit to Kinnard Farms to expand its dairy operations to more than 5,000 cows. However, several neighbors petitioned the state for a review of the permit, which was granted.
In advance of the hearing, Kinnard Farms asked that the case be dismissed, arguing that because a petitioner dropped out, there weren't the required number of parties challenging the permit.
However, Administrative Law Judge Jeffrey Boldt denied the dismissal motion. He noted the requirement for five challengers was met when the petition was filed. And, because someone else joined the case as a challenger, there will be the required five petitioners when the hearing is held.
The hearing is set for Oct. 15, and is expected to last three days.
