MANITOWOC - We're learning new details regarding a death investigation along the Lakeshore.
Police say a Manitowoc man allegedly shot and killed his brother on Sunday. But on Tuesday, the original suspect was released from custody.
A bail hearing for 65-year-old Robert Sullivan was canceled Tuesday afternoon. Sullivan allegedly shot his brother Carey Sunday during an argument.
So far that has not been in dispute. While the investigation remains open, police say this could now be a case of self defense.
Investigators say calls have been coming in, almost by the hour as they try to figure out what happened Sunday night.
"It has been a very difficult process for the Sullivan family, and what we're trying to do is to uncover the very truth that took place that day," explained Manitowoc Police Chief Oscar Dick.
Police say they believe Robert Sullivan shot Carey Sullivan in a dispute over finances and their parents' estate. However, officers are investigating whether this is a homicide case or a matter of self defense.
"His brother, the deceased, was fairly well known to our department and members of the public have called in about him and some of the things they know about him," Dick said.
The Manitowoc Police Department and District Attorney's office issued a joint statement Tuesday:
"The police department continues to receive information pertaining to the investigation on a daily basis, including information related to self-defense and the deceased's history of threatening and aggressive behavior. There is no information currently known to law enforcement of Robert Sullivan having any history of violent or aggressive behavior."
So after reviewing Robert Sullivan's statement and information provided by the public, authorities say the District Attorney's office decided to hold off.
"They reviewed the information that we had, and they felt this time, they would want to wait until later to make a final decision on what the proper charge would be or if there would be any charge at all," Dick said.
FOX 11 spoke to Sullivan's attorney, he declined an on-camera interview but told us over the phone this is clearly a self-defense issue and his client was attacked by his brother.
He says at this point, he's waiting to see what the district attorney's next move will be.
However, it's unclear when a final decision on the case will be made.
Robert Sullivan's attorney also told us his client was a star basketball player. Bob Sullivan was state high school player of the year from Manitowoc Lincoln before becoming one of the University of Michigan's top 50 all-time players.
His father, Bob, senior, was on Wisconsin's only NCAA championship team in 1941.
